Lakewood Board of Supervisors Special Meeting

February 25, 2008

(Meeting Recessed from 2-4-08)

 

Call to Order:  Chair of the Board of Supervisors Tim Musick, called the recessed special meeting to order at 7:01 p.m. on February 25, 2008 at the Lakewood Town Hall.

 

Present:  Supervisors Chuck Campbell, Jerry Larson, Tim Musick, Shannon Ostazeski and Phil Halverson.  Also present were:  Clerk Gene Bromenshenkel, Attorney Tim Strom for the Town of Lakewood, Attorney Shawn Reed for Lipe Bros. Constr. and general public (register attached).

 

Purpose of Recessed Meeting:  To continue with the appeal made by Lipe Bros. Construction on the revised conditional use permit issued by the Lakewood Planning and Zoning Commission.  The meeting is a continuation of the meeting recessed meeting held on February 4, 2008.

 

Chair Musick reviewed the recess decision made on 2-04-08 for a small group of people (up to 6 people) representing the township and Lipe Bros. to strive to develop a proposal to bring to this meeting.

The small group met on February 19, 2008.  A tentative agreement was not reached.  Bob Wolfe, Chair of the Planning and Zoning Commission reviewed the Feb. 19, 2008 meeting and indicated that no agreement was reached.

Attorney Shawn Reed:  All met on Feb. 19, 2008 with both parties in discussion with the parties coming somewhat close on some issues.  Is prepared to go forward with some revised proposals discussed at the group meeting.  He requested to submit the revised proposals.  His understanding was that a proposal would be presented to the Board of Supervisors per the agreement at the 2-4-08 meeting.

Jason Dillon:  Lives at 3393 Strand Road.  As a Lakewood resident, would like to hear the proposal.

Supervisor Halverson:  Is happy to hear the proposal but need to deal with the appeal.

Supervisor Campbell:  Sent issues to a small group to bring a proposal but need also to hear out the appeal process.

Supervisor Ostazeski:  Reason for small group was to avoid a large number of meetings and to move toward an agreement.  Could save time and money for the township to hear the proposal.

Supervisor Musick:  Feels we should proceed with appeal and to submit the proposal to the Town Clerk. 

Attorney Reed:  Cited an e-mail from Attorney Strom on 2-15-08 suggesting that any proposals will be brought back to the Board of Supervisors.

Bob Wolfe to Shawn Reed:  Is this your final compromise?

Reed:  This is a proposal which should bridge some of the gaps of the small group discussion.  Would like to keep options open.

Resident:  Can’t figure out why five Town Supervisors can’t seem to get something done on the issue.

Supervisor Campbell:  Requests that we move on.

Shawn Reed:  Am having a hard time understanding why the Board might not hear the proposal from the appellant.

Jim Rich:  Was under the understanding that both sides were to bring proposals.

Supervisor Halverson:  Don’t see reviewing the three-hour small group meeting but to move on.

Some residents requested a review of the conditional use permit review process which Chair Musick proceeded to do in a brief manner. 

Shawn Reed:  My client came to the small group with a proposal and tonight has a revised proposal.  Reed to Board Members:  Do you want to settle this or not? 

Chair Musick:  What are the wishes of the Board?

Supervisor Ostazeski:  Was of the understanding leaving the Feb. 4th meeting that Supervisors would hear feed back from the small group meeting.  Would also like to hear from Attorney Strom on purpose of tonight’s meeting.

Attorney Strom:  Called Mr. Reed indicating that he (Strom) had made a mistake in terms of a proposal being brought to the Board tonight.

Jason Dillon:  When Lipe Bros. purchased their property, it was assumed that the salvage yard was grandfathered.

Supervisor Musick:  Yes.

Larson:  Would not be ready to determine on a proposal tonight.

Shawn Reed:  Notes that he is filing copies of three pieces of communication with the Clerk at this time –attached with minutes.

Chair Musick asked Board members about hearing the Reed proposal.  Ostazeski:  Would like to either recess or hear the proposal tonight.

Campbell:  Would like to see the proposal and have time to digest.

Larson:  Doesn’t see continuing with this hearing before acting on the proposal.

Motion by Ostazeski to recess the meeting and send the proposal once received, back to the small group.  There was no second to the motion.

Shawn Reed:  What he has prepared is designed to be presented orally—it does not contain detailed and format for a written proposal at this time.  Does not have a word by word written proposal.

Motion by Campbell to request that Mr. Reed and Lipe Bros. prepare and present a written proposal for the public to read which will be discussed, heard and decided upon at a recessed meeting.  Second by Larson.  Motion Carried.

 

Motion by Larson to recess the meeting to Thursday, March 6, 2008 at 7 p.m. at the Town Hall.  Second by Ostazeski.  Motion Carried.
