Lakewood Planning and Zoning Commission Meeting Tuesday, July 25, 2006 at 7:00 p.m. Lakewood Town Hall
Call to order: Commission Chair of the Planning and Zoning Commission, Bob Wolfe called the Public Hearing to order at 7:02 P.M. Present: Chair Wolfe, Phil Halverson, Angie Dickenson-Palmer, Al Eastman, Chris Roningen, Robin Downs, Recorder Shannon Ostazeski, Zoning Administrator Brennan Mears, and public (see attached registrar). Pledge of Allegiance: The Pledge of Allegiance to the flag of the United States of America was recited by all present. Minutes of Previous Meetings: June 20, 2006 Conditional Use Public Hearing: Tabled until the quorum is available on the 1st of August. June 27, 2006 Commission Meeting: Eastman: I was not mentioned in the attendance. Motion to accept the meeting by Eastman. Seconded by Downs. Minutes passed. Select representative to August 2, 2006 Board of Supervisors Meeting: Robin Downs Unfinished Business: Town Board Meeting Report- July, 2006: Bob Wolfe The Board of Supervisors had a special meeting on July 1st where they passed a motion to extend the application process for a 60-day extension on the request for the Planning and Zoning Commission to complete the work on the conditional use permit request. Wolfe: The vote on the conditional use meeting on June 20th was for those conditions. If we don’t get a quorum it stands as written. Halverson: Folmer should propose how he wants to solve this if he believes he cannot meet the condition of having a performance bond. Can we vote on this? This is just a finding that we reviewed the conditions. Wolfe: We need the original quorum to change a condition. Halverson: We are just deciding to give a review to some language and inviting the applicant to come up with something different. Wolfe: If we want to change what is written here we need them to be changed by the original group that sat in on that meeting. We can review this here tonight. Mears: I do believe the deadline ends today. Wolfe: Whom does the extension benefit? Mears: It is to benefit us, to give us more time. Motion by Halverson that this commission states it has reviewed the language and approved it. Also that this commission invites the applicant to make alternative proposals to this condition at the August 1st meeting. Seconded by Downs. Halverson: I am trying to overt someone saying we were not inside the reviewing deadline. It also gives the applicant a chance to come up with an alternative. Eastman: I agree with needing assurance and also with inviting the applicant. I think that the five people that made the original condition need to be here. The time constraint is important but we need the quorum and the applicant should have a chance to be here. Wolfe: I would like to know before the meeting next week that the board is behind Palmer: Can we include in the motion that we agree on the intention of the condition? Downs: Would we still be able to change the condition on Tuesday? Mears: Yes. The commission must present within 35 days of the public hearing that their decision is made. It stands as written. Halverson: The public hearing is over. Downs: The meeting should be open to anyone on the commission to vote. Halverson: So the quorum here is available to vote tonight that we reviewed the language. Motion passes 4 votes to 1. Halverson, Palmer, Downs and Wolfe for. Eastman against. Motion by Halverson that this commission states it has reviewed the language as referenced in the June 20th meeting. Motion dies because it was redundant. Zoning Administrator Report- Brennan Mears Update on Zoning Permits issued: 2 permits issued Proposed Zoning Ordinance ChangeMears: The Town Board has asked me to look at time limits and also at driveway issues. (Handout #1) The Moose Mountain issue is they have two adjoined driveways and the board doesn’t like this. There is a loophole that our attorney brought up in our Ordinance pertaining to this issue. It doesn’t state that you couldn’t have double driveways. This handout is a draft of a text amendment change to Article VI 14.03 I was asked to assemble. Eastman: The County would hold these variances. You realize you are doubling the number of interior parcels allowed? Mears: It says may allow. Nothing is a guarantee, this is based on a variance approval. Mears: The second handout is another text amendment suggestion concerning time limits on appeals. (Handout #2) Palmer: Could Mears make a spreadsheet that says when all these deadlines are? Mears: Yes. Halverson: Did the board suggest a time limit? Mears: Yes. It has been a problem because we lose our time to appeal. Halverson: I have never seen any procedural process that allows you to appeal before a final decision. The problem with the 30 days is? Mears: It can’t supersede the 60 days.
