Lakewood Planning and Zoning Commission Meeting

May 30, 2006

Call to Order:  Chair Bob Wolfe called the May meeting of the Planning and Zoning Commission to order at 7:22 p.m. on May 30, 2006 at the Lakewood Town Hall.

Present:  Eight members---Dick Bodine, Robin Downs, John Knutson, Al Eastman, Ann Cutts, Bob Wolfe, Chris Roningen, and Angie Dickison Palmer.  Also present:  Zoning Administrator Brennan Mears, Clerk Gene Bromenshenkel, and general public (register attached).

Pledge of Allegiance:  The Pledge of Allegiance to the Flag of the United States of America was recited by all present.

Minutes of Previous Meetings:

-         April 25, 2006 Monthly Commission Meeting---Motion by Dick Bodine to approve the minutes as printed.  Second by Robin Downs.  Motion Carried.

-         April 26, 2006 Public Hearing on Zoning Text Amendment---Motion by Robin Downs to approve the minutes as printed.  Second by Angie Dickison Palmer.  Motion Carried.

Representative to June 7, 2006 Board of Supervisors Meeting—Chris Roningen

Zoning Administrator Report:  Brennan Mears

-         Visited Whiteside Road property where issues of concern to neighbors about possible Meth production and zoning have been expressed.  Reviewed the site and found nothing out of order and the setbacks for a mobile home.  A permit for a mobile home was issued.

-         Five zoning permits were issued during the month.

-         Had meeting with Board of Supervisors on May 30th regarding a zoning permit on Moose Mt. Drive.  The issue there is a question of whether or not the private drive is one driveway or two.  The Board of Supervisors initiated a 60-day extension on the permit approval pending an opinion from the attorney on the driveway definition.

-         A variance hearing was held on May 25 regarding a non-conforming parcel due to size.  The variance request was for a lot which was a lot of record pre-1973.  The acreage is less than that now allowed in the zone.  The variance was approved.  There was discussion at the Hearing about whether or not a variance was required.  The Board of Adjustment has requested the Supervisors to obtain a legal opinion based on the Zoning Ordinance language.

-         Permit applications were reviewed by Commission members.  There were some questions and responses from the Zoning Administrator to clarify items on the permits.

Unfinished Business:

  1. Motion by Angie Palmer to defer to next month’s agenda, the item on Zoning Ordinance proposed text changes so members can receive a copy prior.  Second by Al Eastman.  Motion Carried.
  2. Board of Supervisors Meeting Report – from May 3, 2006 Meeting.  Bob Wolfe reviewed the meeting minutes and highlighted major items from the meeting.  The Board of Supervisors approved the Telecommunications Tower Zoning Ordinance amendment as recommended by the Planning and Zoning Commission.  The Board requested that a sub-committee review additional items of concern brought up at the public hearing.  The Chair of the Commission will put together a list of the items of concern and provide copies to members for the next meeting agenda.
  3. LIU-10 Zone and Retail Sales Definition

-         Suggestions were offered on approaching a definition.  One suggestion was that a legal definition of retail sales be obtained.

-         Chair Bob Wolfe feels that the Board of Supervisors is asking the Commission to review the use classification list and determine which uses should be removed as retail sales.  Motion by Al Eastman to appoint a sub-committee to review the classification list for retail sales for the LIU-10 zone.  Second by Chris Roningen.  Discussion on Motion:  concern was expressed about how to define retail sales and a basis for reviewing the list and making a recommendation.  Al Eastman suggested that this item be given attention in the planned update of the Comprehensive Land Use Plan.  There was a call for the question on the vote.  Vote on Motion:  In favor—5, opposed—2.  The Motion Carried.

-         Appointment of Sub-Committee---Bob Wolfe and Robin Downs.

 New Business:

  1. Al Eastman requested an item for consideration---to review the appeals language of the Zoning Ordinance.  Agreed by consensus to consider this as a new business item.
  2. Issue of zoning permit on Moose Mt. Drive---The Board of Supervisors are in the process of obtaining an attorney’s review of the Zoning Ordinance language in reference to the Drive being considered as one or two private driveways.
  3. May 25 Variance Hearing---Ann Cutts reported that the permit was issued.  See Zoning Administrator report for details.  There was discussion about the need for a variance for a non-conforming lot of record.  The Board of adjustment has recommended the Board of Supervisors obtain an attorney review of the Zoning Ordinance language.
  4. Appeal Process:  Al Eastman suggested a re-look at the time period for an appeal to be made to the Board of Supervisors.  He feels that zoning permits should not be issued until after the 30-day appeal period has proceeded.  It was agreed by consensus of the members to recommend to the Board of Supervisors to not issue permits until after the appeal period has passed and to recommend that the appeal period be changed to five business days.  Motion by John Knutson to recommend to the Board of Supervisors that the current appeal period of 30-days be changed to five (5) business days and that zoning permits not be issued until after the appeal period has passed.  Second by Dick Bodine.  Motion Carried with one opposition vote.

    Public Comment:  None

    Announcements:

    The Chair distributed information on planning and zoning workshops to be conducted by The Center for Rural Planning during the next couple months.  One is to be held at the Lakewood Town Hall on July 8th.

    There was no other business for the Meeting.

     Motion by John Knutson to adjourn the meeting at 9:13 p.m.  Second by Chris Roningen.  Motion Carried.
