Lakewood Board of Adjustment Public Hearing Tuesday, March 06, 2007 Lakewood Town HallCall to order: Board of Adjustment Chair Steve Geving called the meeting to order at 7:10 P.M. Present: Chair Geving, members Larry Peak and Ann Cutts, Recorder Shannon Ostazeski, Zoning Administrator Brennan Mears, and public (see attached registrar). Pledge of Allegiance: The Pledge of Allegiance to the flag of the United States of America was recited by all present. Minutes of previous meeting: November 2nd, 2006 Motion by Cutts to approve the minutes. Second by Peak. Minutes approved. 7:00 p.m. Public Hearing: Michael and Jennifer McPherson of 5466 Jean Duluth Road are requesting a variance to construct an addition to their home. The parcel is a lot of record prior to the enactment of the Zoning Ordinance in 1973. According to the Ordinance they do not have a big enough parcel size and do not have the side yard setback to construct the addition to their home. Legal Description of the Property: Beginning at the southwest corner of the N1/2 of S1/2 of NW1/4 of NW1/4 of Section 18, T51N, R13W; thence north along the west line thereof 130 ½ ft.; thence east 300 feet; thence south 1301/2 feet to a point on the south line; thence west along said line to the point of beginning. Peak: How big is the addition? Mears: 384 square feet Geving: Anything else (to Mears)? Mears: No Tim Herstad: Any outbuildings? Mears: Two outbuildings both less than 100 square feet. Applicant McPherson: Presents proposed addition to Chair Geving. Geving: The existing building height must be maintained (no more than two feet higher than current ridge line), current setbacks must be kept and it can be no greater in size than the proposed request. Peak: This is a lot of record within guidelines and this will not affect neighbors. Motion by Peak to approve the variance with the conditions mentioned by Geving. Second by Cutts. All in favor. Motion accepted.
8:00 p.m. Public Hearing: Kerry A. Hanson of 3424 Riley Road is requesting a variance to construct and addition to their home. The parcel is a lot of record prior to the enactment of the Zoning Ordinance in 1973. According to the Ordinance they do not have a big enough parcel size to construct the addition to their home. The request is for a 512 square foot addition. Legal Description of the Property: East 180 ft. of N224 ft. of NW1/4 of NE1/4 of SW1/4 of Section 30, T51N, R13W. Mears: The septic will need to be checked and approved before a permit can be approved because bedrooms will part of this addition. Geving: There were no notices for or against this variance from the public. Peak: Will this include a basement? Applicant Hanson: Yes. Peak: This meets all setbacks. Geving: The existing building height must be maintained (no more than two feet higher than current ridge line), the addition must be build on the west side of the house and it can be no greater in size than the proposed request of 16 x 32 feet. Before we can grant this variance the septic must be approved. Motion by Peak to approve the variance with the conditions mentioned by Geving. Second by Cutts. All in favor. Motion accepted. Geving: Lenny Johnson will no longer be serving on this board. I would encourage the board to consider Dan Dexter. Motion to adjourn by Peak. Second by Cutts.
